## 1. Agreement to These Terms

By creating an account, accessing, or using MapAware, you agree to these Terms of Service ("Terms").

If you do not agree, do not use MapAware.

## 2. MVP/Beta Status

MapAware is currently provided as an MVP/beta service.

This means, among other things:

- features may change, break, or be removed at any time
- availability, uptime, performance, and data durability are not guaranteed
- we may suspend or discontinue the service (in whole or in part) at any time
- MapAware is not designed for high-risk, safety-critical, emergency, medical, legal, or mission-critical use

## 3. Eligibility and Accounts

You must be legally able to enter into a binding contract to use MapAware.

You are responsible for:

- maintaining the confidentiality of your account credentials
- all activity under your account
- promptly notifying us of suspected unauthorized access

## 4. License and Acceptable Use

Subject to these Terms, we grant you a limited, non-exclusive, revocable, non-transferable license to use MapAware.

You may not:

- use MapAware for unlawful, fraudulent, abusive, or infringing activity
- attempt to gain unauthorized access to systems, accounts, or data
- interfere with service operation, security, or rate limits
- reverse engineer, decompile, or attempt to extract source code except where non-waivable law allows it
- use MapAware to transmit malware or harmful code

We may investigate misuse and suspend or terminate access at our discretion.

## 5. Your Content

You retain ownership of content you create or upload to MapAware ("User Content").

You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, and transmit User Content solely to operate, secure, improve, and provide MapAware.

You are solely responsible for User Content and for ensuring you have all rights needed to submit it.

## 6. Collaboration, Sharing, and Third-Party Services

If you share maps or grant access, you are responsible for those sharing decisions.

MapAware may rely on third-party services (for example authentication, infrastructure, collaboration, or embedded media). Their services may affect availability and are governed by their own terms and policies.

## 7. Free Service; No Compensation

MapAware is currently free to use.

To the fullest extent permitted by applicable law, you agree that:

- you are not entitled to compensation, reimbursement, credits, or refunds for outages, bugs, data loss, feature changes, or service discontinuation
- your exclusive remedy for dissatisfaction is to stop using MapAware

## 8. Disclaimer of Warranties

To the fullest extent permitted by applicable law, MapAware is provided "AS IS" and "AS AVAILABLE," with all faults and without warranties of any kind, express, implied, or statutory.

We disclaim, to the fullest extent permitted by law, all implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, accuracy, and data integrity.

You use the service at your own risk.

You are responsible for maintaining your own backups of any data or content that matters to you.

## 9. Limitation of Liability

To the fullest extent permitted by applicable law:

- we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business, goodwill, data, or use
- our aggregate liability arising out of or relating to MapAware or these Terms is limited to the greater of (a) EUR 100 or (b) amounts you paid us for MapAware in the 12 months before the claim (currently expected to be EUR 0)
- you waive, to the fullest extent permitted by law, any right to claim damages beyond this limit

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law (for example, where required by law for willful misconduct, gross negligence, fraud, or personal injury/death).

## 10. Business Users: Representative Actions and Claim Window

If you use MapAware in the course of business, trade, or profession ("Business User"), then to the fullest extent permitted by applicable law:

- claims must be brought only on an individual basis, and not as a plaintiff or class member in any purported class, collective, representative, or private attorney general action
- any claim arising out of or relating to MapAware or these Terms must be filed within 12 months after the claim arose, or it is permanently barred

This section does not limit any non-waivable consumer rights.

## 11. Indemnification

You agree to defend, indemnify, and hold harmless Aurana AB and its directors, officers, employees, and affiliates from claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising from:

- your use or misuse of MapAware
- your User Content
- your violation of these Terms or applicable law
- your infringement of third-party rights

## 12. Suspension and Termination

We may suspend or terminate your access at any time, including for risk, abuse, legal compliance, or operational reasons. Where reasonably practicable, we may provide notice.

You may stop using MapAware at any time.

Sections that by their nature should survive termination will survive, including disclaimers, liability limits, indemnity, governing law, and dispute terms.

## 13. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we may provide notice in the app, by email, or by updating the effective date. Continued use after changes become effective means you accept the updated Terms.

## 14. Governing Law and Disputes

These Terms are governed by the laws of Sweden, without regard to conflict-of-law rules.

If you are a Business User, any dispute arising out of or related to these Terms or MapAware will be subject to the exclusive jurisdiction of the courts of Sweden.

If you are a consumer, mandatory consumer protection law may give you additional rights, including rights to bring claims in your local jurisdiction where applicable.

## 15. Force Majeure

To the fullest extent permitted by law, we are not liable for delay or failure to perform caused by events beyond our reasonable control, including network failures, infrastructure outages, denial-of-service attacks, labor disputes, natural disasters, government actions, or war.

## 16. Miscellaneous

- These Terms and our Privacy Policy form the entire agreement between you and us regarding MapAware.
- If any provision is unenforceable, the remaining provisions remain in effect.
- Our failure to enforce any provision is not a waiver.
- You may not assign these Terms without our prior written consent. We may assign them in connection with a merger, acquisition, or asset transfer.
